On 15 October 2026, we are hosting a free webinar for manufacturers of machinery, plant and packaging machinery. The occasion is 20 January 2027: on that date, Machinery Regulation (EU) 2023\/1230 becomes fully applicable, and the Machinery Directive is repealed with effect from the same day. Which legislation applies to a machine is determined not by its year of manufacture, but by the date on which that specific unit is placed on the market, i.e. first made available on the Union market.<\/h4>\n

The cut-off date applies to each individual machine<\/strong><\/h4>\n

On 20 January 2027, the Machinery Regulation becomes fully applicable, and Machinery Directive 2006\/42\/EC is repealed on the same day. There is no transitional period during which manufacturers could choose between the two.<\/p>\n

What counts is neither the design date nor the date of order, but the placing on the market, i.e. the first making available of each individual unit on the Union market. A machine may therefore have been built and documented entirely in accordance with the Machinery Directive in 2026 and still fall under the Regulation if it is not delivered until after the cut-off date. For order books that extend beyond the turn of the year, this is the most important practical consequence of the Regulation.<\/p>\n

Three points that are often overlooked<\/strong><\/h4>\n

The annexes are being restructured. The essential health and safety requirements move from Annex I of the Directive to Annex III of the Regulation, while the former Annex IV list becomes Annex I. As of January 2027, any template referring to \u201cAnnex I of the Machinery Directive\u201d will point to a provision that no longer exists.<\/p>\n

Four conventional mechanical categories have lost the option of self-assessment. The new Annex I, Part A is discussed almost exclusively as the \u201cAI provision\u201d. However, it also covers removable mechanical transmission devices, their guards, vehicle servicing lifts and portable cartridge-operated fixing machinery. For these products, the involvement of a notified body will become mandatory.<\/p>\n

A software change can make you the manufacturer. \u201cSubstantial modification\u201d now has a legal definition, which explicitly includes modifications made \u201cby digital means\u201d. Anyone who carries out such a modification is considered the manufacturer of that machinery.<\/p>\n

And 20 January is not the earliest deadline<\/strong><\/h4>\n

Since 2018, the WEEE Directive, with its open scope, has covered all electrical and electronic equipment that is not expressly excluded. Since 2021, the Waste Framework Directive has given rise to a notification obligation for articles containing substances on the REACH Candidate List. Both obligations already apply, while the Machinery Regulation is still a matter of preparation.<\/p>\n
