The new EU Deforestation Regulation: What the packaging industry needs to know

The EU Deforestation Regulation (EUDR) requires all companies and traders in certain products derived from cattle, cocoa, coffee, oil palms, rubber, soy and timber to conduct comprehensive due diligence in the value chain. In addition, a due diligence declaration must be available for the goods in question and they must be produced in accordance with applicable local laws, including human rights.

According to the EUDR, ‘deforestation-free’ means that

  1. the goods do not contain or are not produced from relevant raw materials sourced from land that has been lost to deforestation since 31 December 2020;
  2. for certain products that contain or are made from wood, the use of wood leading to forest degradation is not permitted, i.e. wood that has been collected in a way that results in a structural change in the vegetation of certain forests.

Who is affected?

Who in the packaging industry is affected?

In the wood-based sector, the scope includes, but is not limited to, the following goods and products:

  • wood and wood products, excluding recycled products (waste as defined in Directive 2008/98/EC)
  • pulp and paper covered by chapters 47 and 48 of the Combined Nomenclature, with the exception mentioned above and an exception for bamboo fibres.
  • printed books, newspapers, pictures and other printed material, manuscripts, typescripts and plans, with the exception mentioned above.
  • folding boxes fall under the category according to the EUDR appendix (see appendix, p. 140).

In principle, the EUDR states that all wood-based fresh fibres in fibre-based packaging must be:

  • traceable: GPS information per plot must be passed through the value chain
  • free from deforestation and forest degradation: GPS coordinates can be used to check the status of the plot as of 31 December 2020
  • legal: all national laws, including the rights of indigenous people, must be respected.
